Sentence Reduction
The Federal RDAP Program

Residential Drug Abuse
Program is realistically the only avenue a federal inmate has for a
potential sentence reduction other than good time credit. If you qualify
for the RDAP Program you could get up to a 12 month reduction in your sentence
and up to a 6 month community custody (halfway house) designation. The
BOP doesn't just hand sentence reductions out like candy. There are a lot
of conditions that you will have to meet to qualify for the RDAP Program, with
the main condition being that you must have documentation in your PSI Report
history of past drug (including pharmaceutical medications) or alcohol abuse
within one year prior to incarceration. Documentation can be prior
arrests, medical records or clinical assessments. You also can not have a
serious mental disorder or any history of violence or a sexual offense. Please

(Pharmaceutical

be documented but didn't get included in your PSI Report (for whatever reason),
you need to call us immediately! In this situation the time frame, after
you arrive at prison or prison camp, to file the proper documentation to be
considered for the RDAP Program is very short.

Government) Sentence Reductions - Only the Government can file the Rule 35
Motion.

This is a request for an
early release under certain limited circumstances that must be made to the BOP
after you are already serving time in prison or a prison camp. The
circumstances include: (1) terminal illness, (2) debilitating physical conditions
that prevent inmate self-care, and (3) death or incapacitation of the only
family member able to care for a minor child. If you fall under one of
these categories make a request to your prison's Team Counselor. Only the
BOP can grant a Compassionate Release.

If you've hired a
reputable, experienced criminal attorney he/she should have gotten any
placement issues you may have inserted into your PSI Report. Although
most are, not every attorney is reputable or experienced. If you have
questions about what possibly could affect your placement location, or if you
need help with this issue, call us. The BOP has final say on any and all
prison placements. It's the policy of the BOP to place individuals in the
least restrictive facility, for which he/she qualifies for, which is within 500
miles of their release residence.
